Probate and Trust Administration:
Probate is the process where a court oversees the administration of a deceased person’s estate, ensuring that any final bills, taxes and expenses are paid, and any remaining assets are distributed to the beneficiaries named in a will, or if the decedent died without a will, or “intestate”- to the decedent’s heirs as defined by the California Probate Code.
Renee Linton represents and advises both individual and fiduciary clients in all areas of trust and estate administration including the funding and administration of trusts, probate proceedings, and termination of trusts and estates and asset distribution. We offer complete postmortem trust administration, advising our clients about any issues arising during the course of the trust administration, including the duties and powers of the trustee, accounting, valuation of assets, creditor’s claims, and trustee compensation.
Probate and Trust Litigation
We handle all aspects of probate and trust litigation, including the defense and prosecution of will and trust contests, creditors’ claims, disputes regarding the interpretation of wills and trusts and entitlement to distributions from trusts and estates, controversies surrounding fiduciary conduct and accountings, and claims of financial elder abuse.

A conservatorship is a court proceeding where a judge determines that a person (the “conservatee”) is unable to care for his or her personal well-being or finances, and appoints a conservator to handle the conservatee’s care and/or finances.
We assist those facing the permanent or temporary incapacity of a loved one with establishing and administering conservatorships. We understand the challenges presented by the incapacity of a loved one and will guide you through this difficult time.
A guardianship is a court proceeding where a judge gives someone custody of the child and/or the power to manage the child’s property and finances. We assist our clients with drafting guardianship provisions in wills, nominating a guardian of the person and the estate for their minor children, and also represent clients in guardianship proceedings.
